General Terms and Conditions (GTC) of F&W Reflexintegration
1.1) These General Terms and Conditions (“GTC”) apply to all contracts with participants in the F&W Reflexintegration training and video training programs and to all services provided by F&W Reflexintegration.
1.2) For the sake of readability of the Terms and Conditions, the term "participant" (m/f/d) is not grammatically listed in the feminine form.
§2 Changes to the Terms and Conditions
2.1) F&W Reflexintegration reserves the right to amend these Terms and Conditions with future effect. F&W Reflexintegration will only make such amendments for compelling reasons, in particular due to new technological developments, expansions of services, changes in laws or case law, or other equivalent reasons.
2.2) Changes require the participant's consent. The participant agrees to be informed of changes to the Terms and Conditions upon registration or login to the respective platform or via email to the email address they last provided. The amended Terms and Conditions are deemed accepted if the participant does not object in writing or text form (e.g., by email or fax) within 8 weeks of receipt ("objection period"). F&W Reflexintegration will specifically draw attention to this fact in the notification of changes.
2.3) If the participant does not object to the amended Terms and Conditions within the objection period, the amended or supplementary terms and conditions will become effective with respect to him.
2.4) If the participant objects within the stipulated period, both the participant and F&W Reflexintegration are entitled to terminate this contract. Any service fees paid in advance for the termination period will be refunded proportionally.
2.5) F&W Reflexintegration will specifically point out in the notification of changes the possibility of objection and termination, the deadline and the legal consequences, in particular with regard to a failure to object.
§3 Contract conclusion and payment agreement
3.1) The education contract is concluded upon submission of the completed online form provided on the website www.fundw-reflexintegration.de and its submission, as well as written confirmation of acceptance from F&W Reflexintegration. Before submitting the online application, the participant can view and change their data at any time.
3.2) The offer can only be submitted and transmitted if the participant has previously accepted these Terms and Conditions by clicking the "REGISTER BINDINGLY" button.
3.3) F&W Reflexintegration will confirm acceptance immediately, insofar as this is feasible in the ordinary course of business.
3.4) F&W Reflexintegration stores the data provided by the customer, along with the respective registration date, in a database. This data is not accessible to the customer. Participants are referred to the data privacy statement, which can be accessed at https://www.fundw-reflexintegration.de/en/privacy-policy/.
3.5) The invoice for the education fee (video package and in-person courses) will be sent with a payment due within the next 7 days. Participation in the video package is contingent upon F&W Reflexintegration receiving full payment. Participation in the in-person courses is contingent upon F&W Reflexintegration receiving full payment before the course begins. If payment is not received, or only partially received, before the course begins, participants have the option to pay the outstanding amount on-site, subject to a 5% late payment fee, either in cash or by card. Otherwise, participation is not permitted.
§4 Services and reservation of the right to make changes
4.1) The education services correspond to the advertised content.
4.2) F&W Reflexintegration reserves the right to change or adjust minor services at short notice.
§5 Non-participation/Rebooking
5.1) Since only a limited number of participants are admitted to the F&W Reflexintegration education courses, the full education fee remains payable even in the event of non-attendance, unless otherwise stipulated below. Any expenses saved by F&W Reflexintegration will be credited.
5.2) After a binding booking, cancellations made up to 2 weeks before the course start date will incur a 20% cancellation fee. Cancellations made less than 2 weeks before the course start date will incur a 100% cancellation fee.
5.3) Rescheduling to a different in-person course date is free of charge up to four weeks before the original date. After that, a flat fee of 10% of the original course fee will be charged for rescheduling up to two weeks before the course begins, and a flat fee of 20% of the original course fee for rescheduling within two weeks of the course beginning. Rescheduling is generally only possible to a date offered at the time of registration.
5.4) Alternatively, the original participant may nominate a suitable replacement participant at any time before the start of the training. In this case, there are no additional costs.
5.5) In order for rebooking requests to be taken into account, any notification of a rebooking request or a substitute participant must be in written form.
§6 Knowledge transfer and copyright
6.1) The knowledge imparted in the F&W Reflexintegration education may only be used for treatment/application for therapeutic purposes.
6.2) Any other disclosure to third parties, in any form whatsoever, is prohibited. An exception is made for those documents that F&W Reflexintegration has explicitly provided to participants for distribution to patients (e.g., flyers with reflexes). All distributed documents are protected by copyright, and the name "F&W Reflexintegration" is protected by trademark and designation rights.
6.3) Regardless of the existence of copyright protection, the transfer, reproduction, distribution and/or public dissemination of the documents (even in part), the access data for future F&W Reflexintegration education courses, as well as the use of the trademarks and logos, is prohibited without the written consent of F&W Reflexintegration.
6.4) Video or audio recording during F&W Reflexintegration education sessions is prohibited.
§7 Participants' personal responsibility
7.1) In the education to become a certified F&W Reflexintegration therapist, participants learn various techniques. Different therapeutic professions, such as physiotherapists, physicians, alternative practitioners, as well as massage therapists, personal trainers, sports scientists, psychotherapists, and other therapists, can learn the techniques that best suit their respective professional profiles. How the acquired knowledge and techniques are subsequently applied by the participants depends on their individual needs and professional regulations. Each participant uses the techniques taught by F&W Reflexintegration independently, within the framework of their professional profile and legal framework, and always in compliance with the applicable regulations and provisions.
7.2) Participants actively taking part in the education courses are required to disclose any physical and/or mental complaints and limitations to prevent any injury to body, life, freedom or health.
7.3) Participants with physical or mental limitations agree to actively participate only in the theoretical portion of the course. If physical limitations have not been disclosed to F&W Reflexintegration, the participant is solely responsible for any resulting consequences.
§8 Liability of F&W Reflexintegration
8.1) F&W Reflexintegration is liable in cases of intentional or grossly negligent breach of contract, as well as in cases of breach of warranties and breach of cardinal obligations (i.e., obligations whose fulfillment is essential for the proper execution of the contract and on whose fulfillment the participant therefore relies), and in cases of injury to life, body, or health, in each case caused by F&W Reflexintegration or its agents. In cases of breach of warranties and cardinal obligations, claims for damages are limited to foreseeable, typical damages.
8.2) In all other cases, liability is excluded.
8.3) The personal liability of the employees, management and agents of F&W Reflexintegration is limited in the same way as the liability of F&W Reflexintegration.
§9 Force majeure
9.1) In the event of cancellation of an F&W education course or parts thereof due to force majeure, there is no entitlement to its completion. The cancelled education part will be rescheduled as soon as possible on a replacement date communicated by F&W Reflexintegration.
9.2) In the event of a cancellation of an event / course or part of a course through no fault of our own (for example, due to illness of the instructor, a pandemic or force majeure), the right to the full participation fee remains, unless F&W Reflexintegration is unable to hold a replacement date within a reasonable time.
9.3) F&W Reflexintegration will make every effort to reschedule the cancelled event/session or course segment within a reasonable timeframe. In this case, F&W Reflexintegration reserves the right to have the course conducted by other instructors or to change the course/education times.
9.4) If only one part of the course is cancelled (e.g., an in-person session due to illness or a pandemic), the right to have the feasible course parts carried out and to receive payment remains, as long as the remaining course parts cover the entire subject area of the education or F&W Reflexintegration immediately offers alternative solutions for the cancelled course parts.
10.1) This section of the Terms and Conditions regarding membership applies to all participants who have become members of F&W Reflexintegration after their application has been accepted by F&W Reflexintegration. F&W Reflexintegration membership is an association of graduates interested in quality and further education within the F&W Reflexintegration method.
10.2) Only after certification as an F&W Reflexintegration therapist will the member be listed in the therapist finder and the therapist list with search function on the F&W Reflexintegration homepage.
10.3) The title “Certified F&W Reflexintegration Therapist” and the F&W Reflexintegration logo/seal may only be used and listed in the electronic therapist finder on the F&W Reflexintegration homepage only those who are active and have not cancelled their membership.
10.4) Membership lasts for one year and can be cancelled up to 3 months before the end of the year. Cancellation must be in writing. If F&W Reflexintegration does not receive a cancellation notice within the required timeframe, the membership will automatically renew for another year with all associated rights and obligations.
10.5) A general, one-time right of termination is granted within 2 weeks immediately following the conclusion of the membership without giving reasons; otherwise, the deadlines according to section 10.4 apply.
10.6) Upon booking the education course, the member receives access rights to all files and video materials from F&W Reflexintegration, which are exclusively available to members, after payment has been received. The invoice for the annual membership fee will be sent with a payment deadline of 7 days. Upon termination of membership, access rights to all files and video materials are revoked.
10.7) Through regular online supervision sessions, members of F&W Reflexintegration continuously receive new knowledge and insights from practical research, as well as answers to individual, therapy-relevant questions.
10.8) Membership serves, among other things, to ensure quality and thus guarantee consistently high patient satisfaction. To safeguard the associated expectations of exceptional treatment quality and in the interest of patient safety, a certified F&W Reflexintegration therapist should participate in at least two online supervision sessions per year.
11.1) F&W Reflexintegration is entitled to make changes to the terms of membership, in particular to adjust the amount of membership fees, with effect for the future.
11.2) Changes require the member's consent. The member agrees to be informed of changes upon registration or login to the respective platform or via email to the email address they last provided. The amended membership Terms and Conditions are deemed accepted if the member does not object in writing or text form (e.g., by email or fax) within 8 weeks of receipt ("objection period"). F&W Reflexintegration will specifically draw attention to this fact in the notification of changes.
11.3) If the member does not object to the amended membership terms within the objection period, the amended or supplementary terms will become effective with respect to him.
11.4) If the member objects within the stipulated period, both the member and F&W Reflexintegration are entitled to terminate the membership. Any membership fees paid in advance beyond the termination date will be refunded proportionally.
11.5) F&W Reflexintegration will specifically point out in the notification of changes the possibility of objection and termination, the deadline and the legal consequences, in particular with regard to a failure to object.
12.1) Each party to the contract has the right to terminate the contract for good cause.
12.2) F&W Reflexintegration is particularly entitled to terminate the participation agreement immediately and to exclude the participant if, despite a written warning with threat of termination in case of repeated non-compliance, the participant again fails to comply with an order or instruction of the lecturer, violates the house rules of the seminar premises, or contravenes § 6.
12.3) The obligation to pay the education fee remains in effect in these cases. Any expenses saved by F&W Reflexintegration will be credited.
12.4) The right to assert further claims, in particular claims for damages, remains reserved.
13.1) No verbal side agreements were made.
13.2) The law of the Federal Republic of Germany applies.
13.3) The exclusive place of jurisdiction for disputes arising from or in connection with this agreement is, to the extent permitted by law, Freising.
